Gemini已提交駁回SEC對Gemini Earn訴訟答辯書:8月19日消息，Gemini已提交駁回SEC對Gemini Earn訴訟答辯書。Gemini表示，SEC稱根據貸款協議的具體條款，設立Gemini Earn計劃并為用戶提供將數字資產向Genesis出借機會，Gemini參與了非法銷售未經注冊的證券。這意味著美國證券交易委員會必須證明兩件事：證券的存在和“此類證券”的出售，SEC無法證明任何一項。

Gemini表示，SEC甚至無法決定什么是證券。一方面他們聲稱貸款協議是一種擔保。另一方面他們聲稱整個Gemini Earn計劃本身就是一種證券。另一重點在于SEC試圖認定“出售”。SEC認為Gemini和Genesis實際上“出售”付息承諾以換取加密資產，然而出售和貸款是兩類事情。[2023/8/19 18:10:06]
